Summary

The facility failed to ensure that allegations of abuse and an injury of unknown source were reported to HHSC within 2 hours of the allegation being made for two residents. The deficiency involved Resident #13, an elderly female with senile degeneration of the brain, severe cognitive impairment by BIMS score, and partial/moderate assistance needs for transfers, and Resident #19, an elderly female with senile degeneration of the brain, anxiety disorder, intact cognition by BIMS score, and dependence on staff for toileting hygiene and other ADLs. For Resident #13, the record and interviews showed that CNA B allegedly grabbed her right forearm and forced her to sit down to make her stay in bed, which resulted in a bruise to her right forearm. Resident #13 told surveyors that the CNA grabbed her by the forearm, pushed her down, and told her not to fight. RN A stated Resident #13 reported that the CNA was rough and pinched her, and RN A said she immediately reported the allegation to the ADON and Administrator. The ADON stated she did not report the incident because she did not feel it was abuse or neglect, and the Administrator stated she was not aware of the pinching allegation or the bruise until after surveyor intervention. The record also showed the skin assessment for the bruise was not completed until after surveyor intervention. For Resident #19, the record and interviews showed she reported that a CNA, identified by staff as CNA B, was rough with her during care, grabbed her arm roughly, and turned her roughly while providing care. Resident #19 said she was scared and had reported the CNA to staff. RN A stated she notified the Administrator immediately by text message after Resident #19’s allegation, and LVN C stated she also reported the allegation to the Administrator. The Administrator acknowledged that the allegation should have been reported to HHSC within 2 hours, but it was not. Staff interviews reflected that the allegation was treated as a grievance rather than being reported as abuse within the required timeframe, and CNA B continued to work on the unit after the reports.
