Summary

The facility failed to ensure residents were free from abuse for 2 of 3 residents reviewed for resident abuse. One resident, a female with senile degeneration of the brain and a severely impaired BIMS score, was found with a bruise on her right forearm after reporting that a CNA grabbed her by the forearm and forced her to sit down to make her stay in bed. She stated the CNA was rough, had long fingernails, and caused the mark when she tried to pull away. The resident also said this was not the first time the CNA had grabbed her and that she was scared. The resident’s record did not reflect a skin assessment completed on the date of the incident until after surveyor intervention. Staff interviews showed the ADON had observed the resident in bed early and was told the resident had been made to go to bed, but she did not report that event because she did not think it was abuse or neglect. RN A later reported that the resident said the CNA was rough and pinched her, and the Administrator stated the CNA was identified from the schedule as CNA B. The Administrator also stated CNA B was not suspended or spoken to about the incident and continued to work with the resident. A second resident, a female with senile degeneration of the brain, anxiety disorder, hypertension, intact cognition, and dependence on staff for toileting hygiene and other ADLs, reported that an African American CNA with glasses on the 2 PM to 10 PM shift was rough during care. She said the CNA grabbed her arm roughly, was rough when turning her, and told her she did not care if she was fired because she could work somewhere else. RN A reported the allegation to the Administrator, and the ADON and DON later identified CNA B as the CNA matching the description. The Administrator and DON stated the allegation was considered abuse, but the DON also stated she did not receive the report when it was first sent and therefore did not immediately act on it.
