Failure to Document and Investigate Allegation of Staff-to-Resident Abuse
Summary
The facility failed to fully investigate an allegation of staff-to-resident abuse involving a resident with contracture, muscle weakness, need for assistance with personal care, cognitive communication deficit, restlessness and agitation, and depression. The resident’s quarterly MDS showed a BIMS score of 12 out of 15, indicating moderate cognitive impairment. During interview, the resident stated that a CNA hit her in the face twice, handled her roughly during care, pushed her back in the wheelchair, and called the nurse because she would not let the CNA help her. The resident also stated she felt safe and did not feel threatened, and that the doctor assessed her that day. Review of the resident’s record showed no clinical progress notes, incident report, social services assessment or report, or care plan update related to the alleged incident. The facility policies reviewed stated that allegations of abuse require witness interviews, documentation of witness accounts, psychosocial support, monitoring for psychosocial well-being, and care plan revision when mental or psychosocial needs change as a result of an abuse incident. The resident’s progress notes and care plan contained no information about the alleged event, and the EHR did not include documentation showing the incident was acknowledged in the record. During interviews, the Director of Social Services stated she would assess the resident, provide daily checks, and document anything after an incident, but she did not recall any incident with the resident and found no progress notes related to her. The ADON and Administrator stated that allegations of abuse would be discussed in morning meetings and that incidents are usually reported by nursing and followed by care plan updates, but the Administrator later stated the event was not considered an incident because it was initially reported by the resident’s daughter. The MDS Coordinator stated she would look for changes or updates related to the resident but did not provide any information after the interview.
