Summary

The facility failed to protect a resident from neglect by not following the individualized care plan requirement for two staff members during bed mobility. The resident had a history of hemiplegia and hemiparesis following a cerebral infarction, and a quarterly MDS showed the resident was cognitively intact but required total staff assistance for self-care, bed mobility, and transfers. The care plan dated September 15, 2022, directed staff to use bilateral bed enabler bars and provide assistance from two staff members for bed mobility, and the resident’s documentation survey report for May 2026 also reflected the need for two-person assistance with bed mobility. On May 19, 2026, a nurse aide reported hearing a crack in the resident’s left hip area while rolling the resident to change her, and the resident immediately complained of pain. An x-ray completed shortly afterward showed a fracture of the left distal femur, and the physician and nurse practitioner ordered transfer to the hospital emergency department for evaluation and treatment. The x-ray report identified a mildly separated, slightly displaced acute spiral fracture of the distal left femur. The facility’s investigation found that after the resident was transferred back to bed using a mechanical lift, one nurse aide left the room and the remaining nurse aide continued care alone. During incontinence care and turning the resident in bed, the nurse aide heard a popping sound and the resident reported pain in the left hip area. The investigation substantiated caregiver neglect and determined that the failure to follow the two-person bed mobility intervention resulted in the resident sustaining the left femur fracture.
