Care Plan Not Updated for Resident With Behavioral and Inappropriate Sexual Conduct

Summary

The facility did not ensure that a comprehensive, person-centered care plan was updated and implemented for a resident with behavioral symptoms after incidents involving inappropriate sexual behavior toward another resident and later behavioral escalation. Resident R46 had diagnoses including Type 2 diabetes, Bipolar Disorder, hypertension, kidney disease, bilateral above-the-knee amputations, and insomnia. Facility records showed a grievance stating that R46 entered another resident’s room, lifted her shirt, and put his mouth on her breast. The care plan was updated afterward with only one intervention to re-educate the resident to stay away from that resident, and the care plan contained no mention of inappropriate behavior. A later behavioral assessment for R46 identified yelling, repetitive verbalizations, agitation/irritability or hyperactivity, and verbal aggression. The assessment also marked that the resident was an immediate threat to others and required immediate intervention, with a comment that he was “just angry for no reason” and would not listen to redirection. Despite these findings, the resident’s care plan had no goals or interventions added after the assessment. Facility documentation also reflected that R46 was accused of sexual abuse against another resident again in a later incident. During observation, R46 was seen in a wheelchair going past the room of the other resident despite being instructed not to go beyond that area. When redirected by staff, the resident became verbally aggressive and stated that he paid to be there and did not care what staff said. Staff interviews confirmed that R46 was aware of the restriction, was not easily redirected, and could spit, throw things, curse at staff, and physically attack staff. The DON acknowledged that more goals and interventions could have been added after the incident investigations.
