Unauthorized Recording of Resident During Toileting Care

Summary

The facility failed to ensure a resident remained free from emotional and psychosocial abuse, exploitation, and invasion of privacy when an NA intentionally recorded the resident on a personal cellular telephone during toileting care and while the resident was using the toilet without the resident’s knowledge or consent. The report states this resulted in actual psychosocial harm through humiliation, loss of dignity, and violation of privacy. Resident 1 had diagnoses including dementia with psychotic disturbance, restlessness, and agitation. The resident’s annual MDS showed moderate cognitive impairment with a BIMS score of 9 and that the resident required moderate staff assistance for toilet transfers and transfers between the bed and wheelchair. The care plan identified behaviors such as yelling out, negative statements, paranoia, and crying, and directed staff to explain care before providing assistance, maintain a consistent routine, speak calmly and reassuringly, and postpone care if the resident became combative until the resident regained composure. Facility investigative documentation and staff interviews showed that an NA displayed a video on a personal cell phone to other staff members. The recording depicted the resident in bed while the NA repeatedly instructed the resident to get up without providing assistance, then being taken to the bathroom where the NA continued recording while the resident sat on the toilet. The resident was shown asking for help off the toilet, being told, "You can get in the chair," struggling to return to bed, and kicking the wheelchair after assistance was not provided. Staff reported that the NA commented during the recording, "See this is why I have bruising. This is what I have to deal with." The NA later confirmed recording the resident because she was tired of the resident’s behavior and wanted video proof to protect herself, and acknowledged she knew facility policy prohibited recording residents.
