Summary

The facility failed to ensure that a resident was free from abuse that resulted in actual physical harm. The deficiency involved a resident with diagnoses including dementia and major depressive disorder who had documented behavioral concerns, including physical aggression, verbal aggression, threatening behaviors, and a history reported by family of hitting others with a cane, throwing a walker, and other disruptive behaviors. The resident’s record also showed moderate cognitive impairment and use of a walker for ambulation, but there was no documented evidence that the cane used in the incidents was the resident’s preferred assistive device or that the resident had ever been assessed to use it. The first incident occurred when the resident was documented as hitting a roommate in the chest with the cane. A nurse aide stated that the resident was continuously hitting the roommate and thrusting the cane into the roommate’s chest, and that the roommate did not want to leave the room. The roommate later stated that he had been hit in the chest a couple of times with the cane. The resident’s family had previously reported worsening behaviors, including repeatedly hitting family members with the cane, calling police claiming to be kidnapped, and eloping. A later incident involved the same resident striking another resident, who had diagnoses including hemiplegia and hemiparesis following cerebral infarction, major depressive disorder, hoarding disorder, and obsessive-compulsive disorder. Staff heard the second resident yelling for help and observed the resident striking him forcefully on the back and right side of the head with the cane while he was seated in a wheelchair. The resident was transferred to the hospital with multiple lacerations to the back of the head, required six sutures and 15 staples, and sustained a right wrist fracture requiring a splint. The second resident stated that he was scared, shocked, and in pain during the incident.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed.
