Summary

The facility failed to implement and evaluate effective behavioral health interventions for a resident with major depressive disorder, traumatic brain injury, bipolar disorder, disruptive behaviors, and moderate cognitive impairment (BIMS 8). The resident’s quarterly MDS documented behavioral symptoms including screaming, cursing, and threatening others during the assessment period, and the resident’s care plan included interventions intended to address those behaviors. However, the record showed repeated episodes of yelling, screaming, calling out, cursing, and inability to be redirected over several weeks, primarily during evening and nighttime hours, with staff documentation showing that redirection was often unsuccessful or only slightly effective. Multiple residents on the same unit reported that the resident’s yelling and screaming had persisted for an extended period and significantly affected their ability to rest and sleep. During a resident group interview, residents described frequent vocalizations heard throughout the unit at various times of day and night, and resident council members stated the situation had been ongoing for a long time without improvement. The resident council also documented a verbal grievance related to the resident yelling for help during nighttime hours. Nursing notes reflected repeated disruptive behaviors in April, May, and June, including yelling in the hallway, at the nurses’ station, and cursing at staff and other residents, with several entries noting that the resident could not be redirected. During interviews, an LPN stated the resident’s behaviors routinely escalated during the evening and overnight shifts and were more manageable during the day because staff had interventions available and the resident’s daughter often assisted. On observation, the resident was seen sleeping in a chair at the nurses’ station on multiple occasions. The DON and NHA were unable to provide evidence that the facility had evaluated the effectiveness of the existing behavioral interventions or revised the care plan in response to the persistent pattern of behaviors. The facility also could not show that additional interventions later used for the resident, including a busy box and interventions related to past smoking habits, had been considered or implemented earlier despite the ongoing documented behaviors and resident complaints.
