Failure to Protect Cognitively Impaired Resident from Sexual Contact

Summary

The facility failed to protect a cognitively impaired resident from non-consensual sexual contact by another resident who had a documented history of sexually inappropriate behavior toward her. Resident R1 had diagnoses of Alzheimer’s disease, dementia, and bipolar disorder, and her MDS indicated moderately impaired cognition with impaired daily decision-making. Resident CR2 was initially documented as cognitively intact, but later records added dementia. The report states that CR2 had repeated sexually inappropriate interactions with R1, including entering her room, kissing her, and being found with his hand under her covers near her chest or groin area. Facility documentation and staff statements show that the behavior escalated over time and that prior boundaries were not effectively enforced. A nurse documented that CR2 attempted to follow R1 into her room and kissed her despite being told not to. Another note stated that constant redirection was not working because he continued to go into R1’s room and became angry when asked to leave. Earlier, staff had also observed CR2 in R1’s room with his hand under her blankets near her groin or breast area. The report also states that the facility did not timely obtain psychiatric evaluation for either resident after the incident, and that R1’s family had expressed that they wanted no kissing, touching, or private visiting between the two residents.
