Summary

The facility failed to implement its abuse policy by not thoroughly investigating and documenting an abuse allegation and by not notifying the ombudsman of the investigation for one resident. The facility policy titled "Abuse, Neglect, Exploitation or Misappropriation- Reporting and Investigating," revised 09/2022, stated that reports of resident abuse, including injuries of unknown origin, are to be thoroughly investigated and documented, and that the investigator notifies the ombudsman that an abuse investigation is being conducted. Resident #1 was bedfast, had diagnoses including type 2 diabetes, anxiety disorder, and neurogenic bladder, and had a BIMS score of 15 indicating intact cognition. A nurse's note dated 01/29/26 documented that CNAs were transferring the resident from bed to a wheelchair with a mechanical lift when the lift tipped and hit the resident's right arm; the resident was assessed afterward and no bruising or fracture was indicated after x-ray. An initial/final incident report dated 02/03/26 showed an allegation of abuse after the resident reported to APS that they were injured during the transfer by CNA #1. Written statements were obtained from CNA #1, CNA #2, CNA #8, CNA #9, and RN #1, and CNA #1 was suspended after the allegation was reported. However, the DON stated there was no documentation that the resident was interviewed regarding the alleged abuse, the administrator stated the resident should have been interviewed and the ombudsman was not contacted, and the ombudsman confirmed they were not notified of the allegation.
