Failure to Supervise a Resident Smoking While Wearing Oxygen

Summary

The facility failed to adequately assess and supervise residents identified as supervised smokers to prevent smoking while oxygen was in place. Resident #43 had diagnoses including DM II, emphysema, COPD, and chronic respiratory failure, and had an order for oxygen at 2 lpm via nasal cannula as needed to maintain oxygen saturation above 92%. Although the resident’s smoking safety screen identified him as not a current smoker, his care plan stated he was at risk for injury related to smoking and needed supervision when smoking, with staff to maintain his smoking materials in a designated area and observe him in designated smoking areas. On 04/14/26, Resident #43 lit a cigarette while wearing oxygen via nasal cannula and sustained burns to his face. The physician later ordered zinc oxide cream for skin irritation, and a progress note documented that he was seen for a skin burn, but there was no additional documentation describing how the burn occurred, what interventions were taken to prevent recurrence, or a treatment plan. On 05/31/26, Resident #43 again went outside with his smoking materials and smoked while wearing oxygen, causing his face to catch on fire around his nose and ears. Resident #43 stated he forgot to remove his oxygen before smoking and reported burns to his nose from the incident. The incident was also described by another resident and staff interviews. Resident #06 stated he saw Resident #43 light his cigarette while wearing oxygen and that the resident’s face caught on fire. LPN #21 stated he responded to the parking lot and observed a singed nasal cannula and burns due to smoking with oxygen in use. Other staff interviewed stated they were unaware of the burn incidents, and the facility did not document the second incident in the medical record, did not notify the provider, and did not investigate the event. The facility’s smoking policy stated oxygen use was prohibited in smoking areas and that residents requiring monitoring were to have direct supervision while smoking.
