Failure to Protect an Unresponsive Resident from Abuse During Medication Administration

Summary

The facility failed to protect Resident #31 from abuse and mistreatment when RN #107 attempted to administer crushed Ativan mixed with applesauce to the resident while she was unresponsive. Resident #31 had an admission date of 11/30/24, diagnoses including COPD, type 2 diabetes mellitus, and chronic respiratory failure with hypoxia, and was documented as having a significant decline related to terminal illness, severe cognitive impairment, and extensive dependence for all activities of daily living. Physician orders included routine and as-needed morphine for respiratory distress and as-needed lorazepam for agitation, restlessness, or anxiety. According to the hospice nurse’s note and family interview, RN #107 brought the medication into the room in applesauce while Resident #31 had deep shallow respirations and was no longer responsive. Hospice Nurse #210 told RN #107 not to continue attempting oral medication because the resident was mouth breathing and could aspirate the applesauce, but RN #107 proceeded to place the applesauce in the resident’s mouth. The resident’s daughter verbally told the nurse to leave the room, and the daughter, hospice nurse, and resident’s son all witnessed the event and described it as abusive. The facility leadership later confirmed they were told the family and hospice nurse reported RN #107 attempted to shove medication in applesauce into the resident’s mouth when she was unresponsive. The Administrator, ADON, and CM stated they did not think of the incident as abuse and did not feel the need to report it to the state agency or investigate it because RN #107 left the facility shortly after the incident. The facility policy required protection from abuse and investigation of all possible incidents of abuse, neglect, mistreatment, or misappropriation, but the report states this deficiency was investigated under Complaint Number 3044559.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed.
