Summary

The facility failed to ensure that a resident with dementia, severe cognitive impairment, and a documented history of sexually inappropriate behaviors had individualized care-planned interventions in place to protect another resident from alleged sexual abuse. Resident #21 was admitted with diagnoses including dementia with behavioral disturbances and Alzheimer’s disease, was described as a poor historian with limited insight and judgment, and had documented sexually inappropriate behaviors such as verbal comments and attempts to touch staff. He was also ordered cimetidine for dementia-related behavioral disturbance, and facility notes repeatedly referenced inappropriate sexual behaviors, but the care plans reviewed did not document those behaviors or include comprehensive individualized interventions specific to them. The record showed that Resident #21 had been moved from the secured memory-care unit to the 300-hall and continued to have behavioral issues, including inappropriate comments to staff and other behaviors discussed in weekly meetings without specific recommendations. The cognitive loss and behavioral care plans were generalized and focused on restlessness, agitation, wandering, and worsening behaviors, but did not address the resident’s sexually inappropriate behaviors. The MDS annual assessment identified Resident #21 as severely cognitively impaired and needing assistance with multiple activities of daily living, yet there was no documentation that he displayed behaviors on that assessment. Resident #23 was also cognitively impaired and lived in a private room. On the evening of the incident, staff found Resident #21 and Resident #23 lying side-by-side in Resident #23’s bed, both naked, with a box placed behind the door. Staff separated the residents, completed assessments, and documented that Resident #23 stated she was consenting and that it was the first time she was going to have sex, while later interviews showed confusion and inconsistent recollections. Witness statements and staff interviews confirmed that Resident #21 had a history of sexually inappropriate behaviors, but the facility had not documented those behaviors in his care plan or implemented individualized interventions before the incident occurred.
