Summary

The facility failed to ensure supervision was maintained during a smoke break, which resulted in resident-to-resident abuse between two residents. One resident had diagnoses including alcohol-induced persisting dementia and care plans noting verbal and physical aggression, poor impulse control, and the need for supervision while smoking. The other resident had diagnoses including bipolar II disorder, borderline personality disorder, muscle weakness, and repeated falls, and also had a care plan noting verbal aggression and the need for supervision while smoking. During the supervised smoke break, the two residents were the only ones in the courtyard and began arguing and calling each other names. One resident stood up from her wheelchair after being verbally provoked, and the other resident grabbed her arm and pushed her to the ground. The resident who fell sustained bruising to her left knee and left inner arm and complained of back pain, with x-rays later showing no fracture or damage. The incident was documented in a self-reported incident, and the altercation was described as occurring during a supervised smoke break. Interviews and observations showed the supervising staff member left the smoking area to get help, leaving the residents alone for a period of time. The staff member stated the residents were outside alone for about two minutes while she ran for help. Another observation showed a staff member supervising smoking walked away from the smoking area and out of sight to retrieve smoking materials, confirming she did not have eyes on all residents during the smoke break. The facility policy stated smoke breaks will always be supervised.
