Summary

The facility failed to ensure residents followed safe smoking practices and permitted smoking in non-designated areas, including residents’ rooms. The smoking policy stated smoking was only allowed in designated outdoor areas and that smoking-related privileges, restrictions, and concerns were to be noted in the care plan. The facility identified 17 residents as smokers, but Residents #111 and #112 were not listed as smokers even though both were observed smoking in their rooms on multiple occasions. Resident #111 had diagnoses including emphysema, chronic angina, chronic kidney disease, anemia, hyperlipidemia, obstructive sleep apnea, fatty liver, major depressive disorder, edema, anxiety disorder, and congestive heart failure. His MDS described him as cognitively intact and did not indicate oxygen use, although the safe smoking review marked him as having short-term memory issues and assessed him as able to smoke safely. Staff documented that he was found smoking in his room in bed, was told smoking had to occur only in a designated area and under supervision, and later was again found smoking in his room while lying in bed. Staff also reported that he had been escorted to the smoking area at one point, and an LPN stated there were three separate times in a 24-hour period that he was found smoking in his room. Resident #112 had diagnoses including end stage renal disease, CHF, DM, COPD, asthma, depression, and GERD. Her care plan initially addressed ADL assistance, then was revised to identify her as a smoker with behavior of smoking in her room and a goal of complying with the smoking policy. Despite this, staff documented that she was found smoking in her room and later used a denture cup filled with water as an ash tray in her room. During interviews, the ADON and Administrator stated the residents were not listed as smokers because they did not smoke, and the Administrator said decisions about residents not following the smoking policy were left to him.
