Summary

The facility failed to ensure that a resident with epilepsy received levetiracetam (Keppra) as ordered. The resident had diagnoses including epilepsy, nontraumatic intracerebral hemorrhage, and hepatic encephalopathy, and the care plan directed that anti-seizure medication be maintained to prevent seizure activity. The physician order required Keppra 750 mg, two tablets (1500 mg total), every 12 hours at 9:00 AM and 9:00 PM, with seizure precautions in place throughout the day and night. On the day of the event, the May 2025 MAR showed both the 9:00 AM and 9:00 PM Keppra doses documented as given at 11:07 PM. However, the medication was not available on the cart when the LPN attempted to administer it, and the LPN later stated the doses were signed for even though they were not available. The LPN did not notify the nurse supervisor, physician, or pharmacy that the medication was unavailable, and there was no documented evidence that the provider was informed that Keppra had not been administered as ordered. Shortly after the late documentation, the resident had a generalized seizure lasting about one minute, became unresponsive for a brief period, and was then restless in bed. The physician ordered transfer to the emergency room, and the resident was sent by EMS and admitted with a diagnosis of seizures. The resident’s representative stated the resident had previously seized when seizure medication was missed or given late, and the physician stated that not receiving Keppra caused harm resulting in a seizure.
