Physical Abuse of a Cognitively Impaired Resident

Summary

The facility failed to ensure a resident’s right to be free from physical abuse by staff. The resident had diagnoses including dementia, anxiety, and hypothyroidism, and the Minimum Data Set documented severe cognitive impairment with verbal behavioral symptoms directed toward others. The care plan identified the resident as a wanderer at risk for victimization related to severe dementia, with interventions to redirect the resident away from other residents’ rooms and move them to a less stimulating area as needed. Facility surveillance footage, a facility investigation, and witness statements showed that a certified nurse aide physically handled the resident during an encounter in another resident’s room. The video showed the resident entering the room, then falling backward out of the room and landing on the floor in the hallway. The facility’s investigative report documented that a housekeeper witnessed the aide swear at the resident and push the resident out of the room, causing the fall.
