Oxygen Therapy Not Administered Per Physician Order

Summary

The facility failed to ensure professional standards of nursing practice were followed when oxygen therapy was administered contrary to the physician’s order for one resident. The resident had diagnoses including acute and chronic respiratory failure with hypoxia, respiratory conditions due to smoke inhalation, and shortness of breath. The quarterly MDS dated 2/21/26 indicated the resident had a BIMS score of 11 out of 15 and was receiving oxygen. On 4/21/26 and 4/22/26, surveyors observed the resident receiving oxygen via nasal cannula connected to an oxygen concentrator set at 1 L/min. The resident’s physician order dated 4/7/26 directed continuous oxygen via nasal cannula at 2 L/min to maintain SpO2 at 92% or higher. The April 2026 MAR showed nurses’ signatures documenting continuous oxygen at 2 L/min, even though the concentrator observed by the surveyor was set at 1 L/min. During interview, the RN stated she needed a physician order for oxygen administration and acknowledged she should have ensured the resident’s oxygen was set to the ordered amount during rounds. The RN stated that if the resident was on too little oxygen, they could go into respiratory distress. The RN/UM and DON both stated the expectation was for nurses to follow physician orders for oxygen administration, and the RN/UM acknowledged oxygen is a medication and nurses should be following POs.
