Failure to Control Legionella in Water System

Summary

The facility failed to develop and implement an effective infection prevention and control program for Legionella in its water system. A review of water testing showed that 9 of 9 LTC resident rooms tested positive for Legionella on 3/28/26, with results reported on 4/9/26, and 2 of those same 9 rooms remained positive on follow-up testing collected on 5/20/26 and reported on 5/29/26. The facility did not perform the biweekly testing recommended by NJDOH CDS, and the LNHA stated the facility had been lagging with testing and could not provide a timeframe for the gap. The LNHA also stated there was no additional testing between the positive April results and the next testing in late May. The facility did not complete a root cause analysis to identify hazardous conditions contributing to the continued presence of Legionella. CDS correspondence stated that after shock remediation, follow-up samples should be collected every 2 to 3 weeks, with no more than 14 days between receiving lab results and the next sampling round, and that the facility should work with its consultant to conduct a root cause analysis after each sample event. CDS also stated that the facility and its consultants had not demonstrated the ability to control Legionella because the bacteria persisted and rebounded, and that a comprehensive hazard analysis had not been completed. The Pathogen Consultant stated that a risk assessment had been completed, but the engineer would identify the root cause and needed to return to determine it. Observation of four private resident bathrooms found four fixed shower heads that were operational, and three of those four rooms had tested positive for Legionella. The fixed shower heads did not have filters. The facility’s water flush logs were incomplete and did not consistently document that every LTC room was flushed twice weekly, including start and end times and staff initials. The Water Management Plan also contained blank sections for Legionella testing procedures, testing locations and frequency, other preventive actions, equipment manuals, and health department directives. Resident #1 occupied one of the rooms that tested positive again on 5/20/26, and the resident’s room remained occupied at the time of the survey.
