Failure to Supervise Resident With Severe Mental Illness and Substance Use
Summary
The facility failed to provide adequate supervision and implement interventions for a resident with schizophrenia, schizoaffective disorder, depression, and psychoactive substance abuse who had escalating behavioral and substance use concerns. The resident’s record showed repeated elopement from the facility, leaving for long periods, returning with signs of alcohol and illicit drug use, and involvement with police on multiple occasions, including jail stays. The resident also had a history of aggression, hallucinations, poor judgment, and medication refusal, and the care plan reflected ongoing behavioral and psychosocial concerns. Facility staff were aware by email and progress notes that the resident’s behaviors were becoming dangerous and that family members were seeking guardianship assistance. The record showed the facility discussed possible discharge, emergency guardianship, and placement concerns internally, but there was no documentation of follow-up on obtaining a physician letter for guardianship, no documented follow-up with Ombudsman resources, and no evidence that the PASRR recommendations were incorporated into the care plan. The resident’s PASRR Level II, completed in February 2026, identified severe psychiatric illness, ongoing illicit drug and alcohol use, poor insight, compromised safety judgment, repeated elopement, and the need for 24-hour care in a highly structured setting. The resident continued to leave the facility and return intoxicated or after using drugs. On 4/24/26, the resident showed signs of overdose after being in the community and was sent to the hospital, where testing was positive for alcohol, fentanyl, PCP, and marijuana, and the physician ordered a 72-hour facility hold for safety and detox. The record also showed repeated refusals of psychotropic medications in March and April 2026, with no documentation in progress notes that the physician was notified of the missed medications. The resident also had episodes of verbal and physical aggression toward staff, including an incident in which the resident grabbed a nurse by the hair and struck the nurse in the eye, prompting police and EMS involvement.
