Summary

The facility failed to protect residents from physical and verbal abuse when one resident with severe cognitive impairment, dementia, and depression repeatedly displayed aggressive and threatening behaviors toward other residents and staff. The resident’s record showed wandering into other residents’ rooms, cursing, threatening to kill others, yelling, and attempting to strike staff. The care plan identified impaired thought process and the need to monitor for triggers, but it did not identify specific triggers or interventions to reduce the resident’s behaviors. On 06/17/26, the aggressive resident followed another resident to that resident’s room and shoved the resident into a wall. Facility documentation and staff interviews described that the resident stumbled into the wall and dropped a cane, and staff reported the resident was verbally threatening the other resident. A CNA stated he/she was the only staff member on the memory care unit that night, that no extra staff came to help, and that the affected resident said he/she was afraid of the aggressive resident. Staff also stated no updated directives, new training, or new interventions were provided after the incident. On 06/19/26, the same resident charged at another resident with raised fists and yelled that he/she was going to kill that resident. The second resident, who had severe cognitive impairment, Alzheimer’s disease, depression, and asthma, was moved off the memory care unit after the incident. The facility’s records and interviews showed the aggressive resident remained on the unit, the residents’ rooms were across the hall from each other, and no room changes or staffing changes had been made on the memory care unit. The DON and Administrator acknowledged the facility was responsible for keeping all residents safe.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
