Summary

The facility failed to notify the resident’s responsible party after the resident had a fall with significant bruising and pain that resulted in transfer to the hospital for evaluation. The resident had vascular dementia, osteoporosis, and severe cognitive impairment, and had an active DPOA on file. The facility’s policies stated that the resident, physician, and family or legal representative were to be informed when there was a change requiring notification, including accidents that resulted in injury, and that when a resident experienced a fall the physician and family would be notified. According to the record and interviews, the resident fell sometime during the night shift and was initially reported in morning report as having had a non-injury fall. The nurse on duty did not contact the resident’s DPOA or hospice care team after the fall and there was no documentation that they were notified. Later that morning, a hospice aide observed the resident moaning, crying, and in significant pain with bruising to the left side of the head and face, and contacted the hospice nurse and the DPOA. The hospice nurse and DPOA requested that the resident be sent to the hospital, and EMS transported the resident out of the facility. Interviews confirmed that the DPOA was not notified by facility staff and first learned of the fall from the hospice aide several hours later. The DPOA stated the resident had significant injury and should have been sent to the hospital as soon as the fall occurred. The interim DON stated the DPOA should have been notified as soon as possible after the fall and that the nurse on duty when the resident fell was expected to contact the DPOA, administrator, DON, physician, and hospice team before the shift ended. The hospice case manager also stated the facility did not notify the DPOA and that the resident had extensive bruising and was screaming in pain when assessed.
