Summary

The facility failed to protect three residents from sexual abuse when the ADON offered and provided personal Xanax to residents in exchange for sexual activity and inappropriate touching. The investigation documented that one resident reported the ADON gave him/her Xanax in exchange for sexual favors, and that the ADON also gave drugs to two other residents. The resident provided text messages that were sexually explicit and discussed the ADON providing Xanax. Another resident confirmed the ADON provided Xanax and touched him/her inappropriately, and a third resident reported receiving two Xanax pills and being fondled while sedated. The residents involved had significant behavioral and psychiatric histories. One resident had a history of aggression, manipulative behavior, sexually inappropriate behavior, substance abuse, mild intellectual disability, opioid dependency, and bipolar disorder with psychotic features. Another resident had a history of substance abuse, disorganized thinking, delusions, paranoia, depression, mania, and schizoaffective disorder. The third resident had diagnoses including personality disorder, substance abuse, depression, schizophrenia, and paraplegia. None of the residents had an order for Xanax. The facility also failed to protect a resident with a history of substance abuse when the AD took the resident in a personal vehicle to purchase marijuana, and the AD and resident used the marijuana together in the vehicle. A housekeeper witnessed the resident and AD riding together and consuming marijuana, and the AD drove while smoking marijuana. The resident reported trading prescribed Ambien for the marijuana and stated that it was possible to purchase and consume marijuana at the facility. The resident's guardian said no one had contacted him/her for permission for the outing and was not aware the resident had left with staff in a private vehicle or consumed drugs.

A resident with stroke-related diagnoses and cognitive intact status was transferred to the hospital for weakness, dizziness, pallor, and low K+. After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
