Summary

The facility failed to protect one resident from physical abuse by another resident. The abused resident had a history of stroke with left-sided weakness and paralysis, atrial fibrillation, anxiety, coronary artery disease, and congestive heart failure, and was documented as cognitively intact. The other resident involved had diagnoses including stroke with right-sided weakness and paralysis, Parkinson’s disease, dementia, major depressive disorder, and anxiety, and was documented in one assessment as cognitively intact, though the care plan also described impaired cognitive ability and thought processes during a urinary tract infection. According to the investigation, the incident occurred when the second resident entered the first resident’s room and became physically aggressive. The first resident reported that the second resident said, “I got something for you,” and then began hitting the first resident, including striking the left eye. The first resident also reported being hit on the left knee and top of the head, and stated that the second resident refused to leave the room when asked. The first resident used a pink cup in self-defense after being struck. The facility’s records also showed that the second resident had previously been described as having no physical, verbal, or other behaviors on an annual MDS. Facility documentation and interviews showed that staff did not stop the altercation before the assault occurred. A CMT stated he/she heard yelling, went to the room, and removed the second resident after the incident had already started. The LPN assessed both residents afterward and found redness and swelling to the first resident’s left eye, while the second resident had no injuries. The police report identified the second resident as the offender and the first resident as the victim, and noted the first resident’s left eye was red and swollen around the eye socket. The incident was also documented in the facility’s alert note and event note, which described the second resident entering the room, yelling and cursing, and being moved to another room after the altercation.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
