Summary

The facility failed to report an incident of neglect of care with serious bodily injury to the State Agency within 2 hours for one resident who fell out of bed and sustained a fractured clavicle and a scalp laceration. The resident’s annual MDS identified the resident as cognitively intact but dependent on staff for toileting, bed mobility, and transferring, with anxiety, pain, and a history of falls with fractures. The care plan identified fall risk related to decreased mobility, a history of falls, and weakness, and included a low bed with a fall mat on the floor and a soft touch call light at the hip. The resident’s fall risk assessment indicated poor recall, judgment, and safety awareness, poor vision, and a history of three or more falls in the past three months. The care sheet also directed that the resident have a low bed, floor mat, and soft touch call light to the right hip. On the day of the incident, the resident was found on the floor beside the bed with blood near the right ear area, the bedside table near the neck, and a stationary chair nearby. Staff determined the resident had raised the bed to a high position and attempted to self-transfer, and the call light was found in the chair next to the bed. The nursing assistant confirmed the bed had been in low position but the fall mat was not next to the bed. The resident was assessed, transferred back to bed with a Hoyer lift, and sent to the ED after the medical provider was notified of the head injury. The resident returned from the hospital later that evening with a closed displaced fracture of the acromial end of the right clavicle and a scalp laceration. RN-C and the DON stated there was miscommunication about the fracture, and the incident report was filed the next morning, which was past the 2-hour reporting requirement. The facility policy required alleged abuse or neglect resulting in serious bodily injury to be reported immediately but not later than 2 hours after the allegation was made.
