Failure to Investigate Abuse and Resident-to-Resident Altercation Allegations
Summary
The facility failed to adequately investigate an allegation of abuse involving a resident with severe cognitive impairment who reported that a staff member kissed him and kissed him back. The resident had diagnoses including bipolar disorder, adjustment disorder with mixed disturbance of emotions and conduct, and depression, and his record showed a BIMS score of 6/15. He told staff that he had kissed a CNA and that the CNA kissed him back, and progress notes documented that the administrator and social worker were notified. Interviews later showed the CNA reported the resident had repeated the statement that they kissed each other, and the CNA said she had reported the behavior to the unit manager, but to her knowledge the allegation had not been investigated. During follow-up interviews, the CNA stated the resident had tried to kiss her on the lips about 1.5 weeks earlier and that she had reported it to the unit manager at that time. The unit manager acknowledged awareness that the resident liked to try to kiss aides and that the CNA had denied the allegation, but he described only redirection and medication for hypersexuality. When asked about the allegation that a staff member kissed the resident, he stated he would assume it should have been investigated as abuse. The nursing home administrator later stated she was aware staff had reported the resident attempting to kiss them, but both she and the DON denied awareness that the resident had alleged he was kissed by staff, despite the resident’s statements and progress notes indicating otherwise. The facility also failed to adequately investigate and report a resident-to-resident altercation involving another resident with severe cognitive impairment and a second resident with moderate cognitive impairment. One resident was observed in the dining room approaching the other and punching him under the right eye, and staff immediately separated them. The assaulted resident reported pain and stated that the other resident had been stealing his clothes and that he had told staff about it. A CNA stated she had witnessed the punch and had reported the clothing-stealing allegation to the administrator before the altercation. The administrator later acknowledged she had learned of the clothing-stealing allegation during the investigation of the assault, but she had not reported that allegation to the appropriate state agency and had not documented the investigation.
