Failure to Protect Residents from Physical Abuse During Resident-to-Resident Altercations
Summary
The facility failed to protect residents from physical abuse when two residents were involved in a physical altercation in the dining room and the incident was substantiated by video review. One resident, who was cognitively intact with a BIMS score of 15/15 and had diagnoses including heart failure, stroke, depression, and malnutrition, reported that another resident had repeatedly backed a wheelchair into them and that they responded by punching the other resident in the head. The resident also reported that facility management told them the camera showed the strike. The other resident had diagnoses including head injury, seizure disorder, anxiety, and depression, was severely cognitively impaired, and was dependent for transfers. The record review and staff statements showed that on the day of the incident, an LPN heard the first resident say, "If you touch me, I will hit you," and saw the second resident close to them before separating the residents. A later review of the facility’s video surveillance showed the first resident approaching the second resident, speaking to them, moving their wheelchair within arm’s reach, and reaching out to make contact with the second resident’s head with the tips of four fingers of the right hand. The second resident then reached for the first resident’s wheelchair and struck it several times, and the LPN intervened after hearing yelling. The facility’s investigation summary stated that physical contact was substantiated, but abuse was denied. A second resident-to-resident altercation occurred in an elevator involving the same cognitively impaired resident and another resident with a brain injury, mood disorder, repeated falls, depression, and epilepsy. Witness statements described the residents grabbing, swinging, and punching each other, with one resident falling to the floor and sustaining a bruise under the eye, while the other sustained skin tears, bruising, and a fall. Staff and management acknowledged the physical contact occurred. The record also showed prior concerns about the cognitively impaired resident’s impulsive and aggressive behavior, including repeated elevator use and wheelchair contact with others, but the care plans reviewed did not show updated interventions after the earlier incident.
