Summary

The facility failed to protect residents from resident-to-resident physical abuse. One resident with diagnoses including auditory hallucinations, delusional disorder, adjustment disorder with anxiety, and paranoid schizophrenia was involved in an incident after a certified nursing assistant heard loud voices and a smack sound coming from the room. The resident admitted to using a racial slur toward another resident and reported being slapped in the face twice. The other resident stated he reacted after being called a racial slur, and the facility documented redness to the sides of the resident’s face. Although the facility substantiated physical contact occurred, it concluded the interaction was not abuse because it was not due to intentional harm. A second incident involved a resident with dementia, PTSD, and adjustment disorder with anxiety who was struck by another resident with Alzheimer’s disease and severe cognitive impairment. The incident summary stated the resident reported being hit on the left leg with a hand and the right leg with a comb. The record showed the wandering resident had a care plan addressing entering other residents’ rooms and wandering, with an intervention to redirect her from others’ rooms. However, no further interventions were noted to ensure she did not continue entering the other resident’s room without permission. Despite the resident’s report and the documented physical contact, the facility concluded that no intentional harm occurred and did not identify the event as resident-to-resident abuse.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
