Resident Left in Soiled Brief for Hours with Call Light Ignored

Summary

The facility failed to protect a resident’s right to be free from neglect when Resident #309 was left in a soiled brief for several hours and his repeated requests for help were not answered. Resident #309 had diagnoses including major depressive disorder, generalized anxiety disorder, muscle weakness, and debility. His MDS showed a BIMS score of 9/15, indicating moderate cognitive impairment, and his care plan identified a need for substantial to maximum assistance with toileting and incontinence care per facility protocol. During observation, the resident’s call light was shown as activated at 8:51 AM, but CNA R did not enter the room until 10:41 AM and left shortly after turning the call light off. When the room was entered, there was a strong odor of urine, and the resident was found lying in a soiled hospital gown, brief, pad, and sheets. He stated he had turned on his call light several times overnight and that staff had said they would return but did not. He reported feeling embarrassed, humiliated, angry, and dehumanized by being left wet and soiled, and said staff ignored him because they did not like or care about him. Further observation showed that staff continued to pass by or enter other rooms without responding to his calls for help. Scheduler/CNA KK asked the resident about staff kindness and timely call light response, but did not provide incontinence care. LPN S entered the room while the resident was yelling for help but did not check whether he was soiled. CNA NN later confirmed the resident had not been changed since the prior evening and stated that his skin was red and irritated during peri care. Multiple staff interviews described ongoing concerns that residents on the hall were often left wet and soiled for extended periods, that call lights were not answered timely, and that the resident was often found in soiled briefs. The resident’s advocate rounding forms also repeatedly documented that staff were not kind, call lights were not answered timely, the room had odors, and the resident was not up and dressed.
