Summary

The facility failed to ensure staff consistently followed its abuse policy requiring immediate reporting of an allegation of abuse to administration. A facility policy titled Resident Abuse stated that abuse, neglect, exploitation, mistreatment, and misappropriation of property are prohibited, and that any staff member who hears, suspects, or witnesses abuse must report it immediately to a supervisor, with the administrator or on-call designee and the DON to be notified immediately. In this case, the DON was not notified until 06/01/26 about an alleged verbal abuse incident that had occurred several weeks earlier on 05/10/26. The allegation involved a CNA who reported that Nurse #1 called Resident #1 a derogatory name and told the resident he/she stinks. Resident #1 had been admitted in April 2024 with diagnoses including unspecified dementia and agitation, and the most recent MDS dated 05/03/26 showed moderate cognitive impairment with a BIMS score of 11 out of 15. During interview, Resident #1 did not remember the incident. CNA #1 stated she witnessed the interaction on 05/10/26 at about 8:00 P.M. and said Nurse #1 used a rude and derogatory statement toward the resident, after which the resident became angry and stood up. CNA #1 said she reported the incident in detail to Nursing Supervisor #1 twice on 05/10/26, including again at shift change on 05/11/26, and said she specifically told the supervisor that Nurse #1 was verbally abusive toward Resident #1. Nursing Supervisor #1 stated she was told that CNA #1 was concerned Nurse #1 was verbally abusive, but the DON said she first learned of the verbal abuse allegation only after HR contacted her on 06/01/26 with CNA #1’s email. The DON stated staff did not implement the facility’s abuse reporting policy regarding immediate reporting of allegations of abuse.
