Summary

The facility failed to provide one-to-one supervision for a resident with severe cognitive impairment and a history of physical aggression toward staff and peers. The resident’s MDS showed a BIMS score of 3 out of 15, diagnoses including bipolar disorder, non-Alzheimer’s dementia, and anxiety disorder, and behaviors of hitting, kicking, pushing, scratching, grabbing, and rejection of care. The care plan directed frequent checks, a motion sensor on the room door, a private room, and after a peer-to-peer aggression episode, one-to-one supervision during waking hours. On the evening of the incident, the resident was assigned one-to-one supervision, but the assigned CNA left before the end of the scheduled shift. Facility records and staff statements showed the resident was in bed when the CNA left, and staff believed the resident was being monitored. However, camera review showed the resident leaving the room and moving through the unit without one-to-one supervision from about 7:12 PM to 7:22 PM. During that time, staff were observed elsewhere in the hallway or occupied with other tasks, and no staff member was seen maintaining continuous eyes-on supervision of the resident. The camera footage showed the resident interacting with another resident in the common area and then pushing that resident in a wheelchair through the unit before the two residents exchanged swatting motions. The incident was reported by another resident, and staff later documented that the resident-to-resident contact was unwitnessed. Interviews with staff and administration confirmed that one-to-one supervision was expected whenever the resident was up and that the supervision was not provided during the period captured on camera. The facility also documented that 15-minute checks were signed off during the same time period, but the resident was still seen on camera without the required one-to-one supervision.
