Summary

The facility failed to fully implement its abuse policy regarding timely reporting, timely resident assessments, and immediate removal of an alleged perpetrator when a CNA was alleged to have been verbally abusive to one resident and verbally and physically abusive to another. The policy stated that care team members must immediately report allegations to the Administrator and the Department of Health, that a nurse supervisor should complete an assessment before moving a resident if injury is observed or suspected, and that any accused or suspected care team member should be immediately removed from the facility. According to interviews, CNA 11 reported that CNA 10 had been rough with Resident P during toileting care and had verbally abused Resident R during the same shift. CNA 11 stated that CNA 10 grabbed Resident P by the wrists during a toilet transfer, causing bleeding and skin tears, and that Resident P was crying and repeatedly asked CNA 10 to leave the room. CNA 11 also reported that CNA 10 yelled profanities at Resident R and told the resident to go to her room. The Administrator stated he was not informed until several hours later, after CNA 11 called him, and that CNA 10 remained on the unit until the end of her shift even though she was later suspended pending investigation. Record review showed that Resident P, who had dementia, chronic kidney disease, repeated falls, COPD, depression, cognitive dysfunction, restlessness, agitation, weakness, and hospice care, had skin tears on the left forearm and was assessed later that day by the DON. The record did not show timely assessment documentation immediately after the alleged incident. Resident R, who was documented as cognitively intact on a quarterly MDS and had diagnoses including dementia, metabolic encephalopathy, anxiety, schizophrenia, depression, and bipolar disorder, was interviewed after the allegation and stated that everyone was good to her except CNA 10, who would "jump all over" her and holler at her. There were no documented assessments or follow-up notes related to the verbal abuse allegation for Resident R.
