Resident Exposed and Roughly Handled During Care

Summary

The facility failed to protect a resident’s right to be free from physical abuse and mental abuse when a CNA roughly handled the resident during care and left her exposed while a non-caregiver observed through a video phone call without the resident’s knowledge. The resident involved had Alzheimer’s disease, anxiety disorder, and malnutrition, and her clinical record showed she was non-weight bearing, not cooperative with transfers or repositioning, and only partially able to assist with bed-to-chair transfers. Her care plan identified an ADL self-care deficit related to Alzheimer’s disease and directed that she be kept in a low bed, transferred with two staff using a mechanical lift, and assisted by two staff for bed mobility. A video recording reviewed by the facility showed the CNA placing her phone so the resident’s bed was visible while an unidentified person appeared in the video call. The CNA was observed grabbing the resident’s wrist, pulling her forward abruptly, placing a hand behind her neck, and jerking her into position. She then pulled the resident up from the wheelchair, removed the resident’s pants, turned her to the bed, and left the room area while the resident remained sitting on the bed. Later, the CNA forcefully pivoted the resident into bed, removed her gown and brief, and left her lying in full view with her breast exposed and only socks on. The resident was seen moving her legs and rubbing the back of her thighs while exposed. The video further showed the CNA returning to the resident, pushing her to her side abruptly, removing the brief from under her hip, and securing a clean brief without performing peri-care. The CNA then rolled the resident, repositioned her, and pulled a gown over her head abruptly. During the incident, the resident touched the CNA’s arm while care continued. The resident’s son stated his mother had been very private and socially conservative and that exposure to anyone other than a caregiver would have devastated her.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
