Summary

The facility failed to ensure a resident was free from physical abuse when a CNA struck the resident on the top of the head during incontinence care. The resident had diagnoses including a left femur fracture, age-related osteoporosis, heart disease, protein-calorie malnutrition, and dementia. The resident’s assessment showed severe cognitive impairment and total staff assistance was needed for hygiene care, dressing, rolling, and transfers; the resident was also always incontinent of urine and bowel. The care plan identified agitation related to dementia, especially in the evenings, and directed staff to use simple communication, cueing, reorientation, and supervision. According to staff interviews, the incident occurred while two CNAs were providing evening care and changing the resident’s brief. One CNA stated the other CNA was rough, did not use comforting language, and continued turning the resident quickly despite the resident repeatedly saying stop, ouch, and get away. The resident became upset, cussed, and swung her arms, then hit the CNA in the face. The CNA reported that after a brief pause, the other CNA hit the resident on the top of the head. The CNA described the action as retaliatory and said the resident then stopped swinging and moved her hands toward her head. Other staff interviews confirmed the resident had known combative behaviors during personal care and that staff should stop care, separate, and let the resident de-escalate. The LPN who was present said the CNA reported being hit by the resident and that the CNA then swung back. The ADON and GM/abuse coordinator were notified, and the GM stated the resident should have been allowed to de-escalate and that holding arms down or restraining residents was against the abuse policy. The facility’s abuse and neglect policy defined abuse as the willful infliction of injury, unreasonable confinement, intimidation, or punishment with resulting physical harm, pain, or mental anguish, and the CNA was terminated after the incident.

A resident with stroke-related diagnoses and cognitive intact status was transferred to the hospital for weakness, dizziness, pallor, and low K+. After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
