Summary

The facility failed to provide necessary behavioral health care and services for one resident with dementia and cognitive impairment who repeatedly yelled at, cursed at, and called names to another resident with Parkinson’s disease and impaired cognition. The facility’s behavior tracking policy required individualized monitoring of behavior frequency, interventions, and effectiveness, along with interdisciplinary review and individualized care plan interventions. The affected resident’s care plan acknowledged that she at times raised her voice at her male friend/peer and included behavior tracking when she was witnessed yelling at him, but the documented interventions remained limited to sitting and talking with her. The resident who was the target of the verbal abuse had diagnoses including Parkinson’s disease without dyskinesia, hypertensive heart disease with failure, chronic congestive heart failure, peripheral vascular disease, and impaired cognitive function. The other resident had diagnoses including dementia without behavior disturbance, depression, hypertension, and weakness, and her assessment showed moderate cognitive impairment and no verbal behaviors directed toward others. Despite this, behavior notes documented repeated episodes in which she yelled at him, used profanity, insulted his intelligence, and interfered when staff tried to separate them. Staff repeatedly observed the two residents in each other’s rooms and described loud arguments that could be heard in the halls and during mealtimes. Behavior tracking showed the yelling behavior occurred frequently over several months, with 85 documented instances in one month, 92 in the next, then 28, and 12 by early June. Most entries showed the intervention of sitting and talking with her was not effective. Multiple staff members stated the behavior was ongoing, abusive, and known throughout the facility, and several said they had separated the residents multiple times. The Social Services Director and DON acknowledged reviewing behaviors and interventions, but also stated that room changes and other environmental changes were not documented or consistently discussed, and the Administrator said the behavior meetings did not include enough detail and that the resident should have been identified, investigated, and protected.
