Failure to Investigate Repeated Verbal Abuse Allegations Between Two Residents
Summary
The facility failed to ensure abuse allegations were investigated for one resident involved in repeated verbal altercations with another resident. The administrator stated the last abuse investigation had been completed in August 2025 and was not related to the two residents involved in this case. The facility policy required staff who witness or suspect abuse to contact the abuse coordinator, and required the administrator, DON, and/or social services director to interview and/or examine the resident involved and initiate an investigation when abuse was alleged. Resident 1 had diagnoses including Parkinson’s disease, hypertensive heart disease with failure, chronic congestive heart failure, peripheral vascular disease, and cognitive impairment. His assessment showed moderate cognitive impairment and a need for moderate assistance with most cares. Resident 2 had diagnoses including polyarthritis, hypertension, dementia without behavior disturbance, muscle weakness, pain, and depression. Her assessment showed moderate cognitive impairment and a need for substantial to maximum assistance with most cares. Both residents had care plans noting a close relationship, and Resident 2’s care plan also identified that she would at times raise her voice at her male friend/peer. Behavior notes documented repeated incidents in which Resident 2 yelled at Resident 1, called him names, used profanity, and made derogatory statements such as calling him stupid and other insulting remarks. Staff described multiple occasions where they separated the residents because of the verbal aggression, and several staff members stated the behavior was abusive and had been ongoing for months. Staff also reported that administration was aware of the situation, that concerns had been brought to social services and nursing leadership, and that the residents were often placed back together despite the repeated incidents. The social services director and administrator acknowledged that verbal behaviors using profanity, yelling, name calling, or derogatory statements would be considered abusive, but the report did not show that an abuse investigation was initiated for the allegations involving Resident 2 and Resident 1.
