Summary

The facility failed to ensure a resident remained free from sexual abuse by another resident. The resident involved had diagnoses including type 2 diabetes mellitus, other psychotic disorder not due to a substance or known physiological condition, and bipolar disorder with psychotic features. Her MDS dated 05/24/2026 documented a BIMS score of 12/15, indicating moderate cognitive impairment. During an observation on 06/04/2026, the resident stated that a male resident had been bothering her and had touched her inappropriately, and she said it did not make her feel good. Facility records and staff statements described an incident in which a housekeeping employee reported seeing one resident's hand in the other resident's genital area. Nursing progress notes documented the resident reporting that the other resident touched her inappropriately, and social services documented that she was calm but visibly uncomfortable while recounting the incident and stated the contact was unwanted. The resident's care plan was updated to reflect the report of inappropriate touching, and a police report was filed. The other resident's social service note documented inappropriate physical contact without consent and impaired judgment and limited insight into the seriousness of the behavior. Additional staff interviews described the event as occurring in a hallway near the elevators, where the housekeeping employee observed the two residents sitting beside each other and saw one resident's hands in the other's private area, with the other resident's hands on top. The employee separated them and brought the resident to the nursing station. Other staff reported that the resident later admitted to holding the other resident's hand and kissing it, while the other resident denied consent and demonstrated where she had been touched. The facility's abuse policy prohibited sexual abuse, including sexual assault, but the event occurred despite staff statements that residents were supposed to be monitored to prevent inappropriate touching.
