Summary

The facility failed to provide personal care in a safe manner and failed to supervise a resident on the patio to prevent a fall. One resident had diagnoses including multiple sclerosis, anxiety disorder, hypertension, bipolar disorder, and paraplegia, and was assessed as having no cognitive impairment but requiring substantial to maximum assistance for bed mobility and being dependent on staff for transfers. Her care plan identified extensive assistance needs, use of a mechanical lift, and high fall risk related to paraplegia, multiple sclerosis, osteoporosis, and low back pain. During care, the resident was in bed on top of a mechanical lift sling when a CNA was assisting her. According to the investigation, the resident unexpectedly grabbed the mechanical lift bar, causing an imbalance and resulting in her rolling to the floor. Staff described that the event happened too quickly to intervene. The resident later reported that she was in bed when the CNA was helping her and that she was rolled out of bed onto the floor, after which she said she broke her leg that day. The resident was later found to have a displaced comminuted fracture of the shaft of the left femur, and the incident was documented as a fall with serious injury. A second resident, who had diagnoses including chronic congestive heart failure, osteoarthritis, hypertensive heart disease, cellulitis of the left upper limb, and spinal stenosis, used a wheelchair and had moderate cognitive impairment with moderate assistance needed for most cares. He was identified as high risk for falls and had a care plan addressing wheelchair safety and anti-tipping precautions. He reported that while wheeling himself outside on the patio, he backed up his wheelchair, went off the edge of the patio where grass was growing behind the cement, and flipped backward, striking his head on the brickwork. Staff and witnesses stated there was no staff outside supervising the patio at the time, and an activity aide said that although someone usually supervised the patio, staff were occupied bringing residents down for the next activity when the fall occurred.
