Summary

The facility failed to keep a resident free from the use of a physical restraint when staff tied the resident’s left arm to the bed rail with a shirt or sheet. The resident had been admitted with diagnoses including hemiplegia and hemiparesis following cerebral infarction and aphasia, and the MDS documented severe cognitive impairment, no behaviors, impairment on both sides of the upper and lower body, and dependence for mobility. The care plan described the resident as non-verbal with impaired functional mobility of the right upper extremity and both lower extremities due to stroke, requiring total assistance and being at risk for abuse and neglect. The resident’s physician orders did not include any restraint orders or behavior monitoring, and the April 2026 progress notes did not document restraint use or an emergency need for restraint. The resident’s x-ray documented mild soft tissue swelling of the left hand. The facility’s final summary to IDPH stated the allegation was substantiated and that applying fabric to secure the resident’s wrist to the bedrail constituted an unauthorized restraint and neglect, regardless of stated intent.
