Summary

The facility failed to ensure residents were free from abuse in two resident-to-resident incidents involving a cognitively intact resident and another resident who was severely cognitively impaired. The facility’s abuse and neglect prohibited policy stated all residents have the right to be free from verbal, physical, and mental abuse, corporal punishment, involuntary seclusion, neglect, misappropriation of property, and exploitation. In one incident, a cognitively intact resident was observed by another resident and a CNA attempting to hit the CNA in the dining room; the other resident grabbed the resident’s arm to stop the attempt and told the resident she was not going to hit staff. The resident’s nurse documented a possible resident-to-resident altercation and noted bruising on the resident’s arm. The CNA stated the resident called her a name and then reached around to hit her, and the other resident grabbed the resident’s arm. In a second incident, a CNA observed an altercation outside the dining room between two residents when one resident struck the other after the second resident accidentally bumped into the first resident’s wheelchair. One resident’s record documented cognitive intactness, while the other resident’s MDS documented severe cognitive impairment. Nursing notes documented a resident-to-resident incident and that the residents were separated immediately. The cognitively intact resident stated the other resident was grabbing her shoulder and poking at her, and that she yelled for the resident to stop and then shoved the resident’s wheelchair. The CNA and SSD both stated the resident with intact cognition hit the other resident, while the nurse assigned to one resident was not in the dining room when the incident occurred.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
