Summary

The facility failed to protect residents from verbal abuse by another resident. R1, who was cognitively intact and had diagnoses including paraplegia, traumatic brain injury, thoracic spinal cord injury, adjustment disorder with anxiety, opioid dependence, and chronic pain, and R2, who was cognitively intact and had diagnoses including morbid obesity, bilateral above-the-knee amputations, generalized anxiety disorder, and major depressive disorder, were involved in repeated verbal altercations during shared smoking breaks. The investigation found that R2 was verbally aggressive, disruptive, and used profanity, racial slurs, and threatening comments toward R1, and witness statements corroborated the behavior. During one incident, R1 reported that R2 yelled and cursed at him while they were sharing a smoking break. R2 stated that R1 had intentionally provoked him by making noise near the smoking area, and R2 admitted calling R1 names such as little b****, dirty b****, and cry baby little p****. An LPN stated that R2 was yelling at R1 and also directed offensive language toward staff when they attempted to calm him. Other residents reported hearing R2 loudly complain about R1 and said they left the area because of the yelling and profanity. The Administrator stated that staff were expected to monitor and redirect the residents, and that R1 and R2 were not supposed to have shared smoking times. A second incident involved R2 and R19 during a smoke break when a door problem occurred. Nursing documentation and staff statements showed that R2 began cursing and taunting other residents, saying, "Come on. Bring it on. This chair isn't stopping me, and I will run you over with this chair." Staff reported that R2 yelled profanities at R19, called him names, and threatened to beat him. R19 stated that R2 called him names and that he responded by threatening to kick R2's a**. The Administrator stated that R2 yelled profanities at R19 during the scheduled smoke break and that it was difficult to prevent verbal abuse because it was often impossible to predict when it would occur.
