Disrespectful Staff Conduct and Failure to Preserve Resident Dignity

Summary

The facility failed to protect residents’ rights and maintain dignity when staff used disrespectful language, engaged in confrontational behavior, and acted in ways that embarrassed or upset residents. One cognitively intact resident reported that an agency CNA refused to get the nurse after a disturbance in the resident’s room, called the resident a racist, and later displayed a phone video while saying the resident would not get her fired. The resident stated he had not given permission to be recorded and found the situation embarrassing because he is paraplegic. The CNA stated she had been warned by other staff that the resident was racist and admitted she told him she had audio and video of his behavior, although she said she had not actually recorded him. The Administrator stated the CNA did not act appropriately toward the resident. Another cognitively intact resident who required supervision with toileting, personal hygiene, and transfers stated she was embarrassed and shocked by how she was treated when she asked for help with perineal care and assistance getting to the scale. She stated a CNA told her she was not supposed to help her and that she could do everything on her own, leaving her to clean herself as best she could even though she still smelled feces. When the CNA attempted to push her wheelchair to the scale, an LPN stopped them and told the resident she could push herself and needed the exercise. The resident stated she was upset because staff made her do everything herself and she had to eat a cold breakfast. The LPN and CNA both stated the resident was capable of pushing herself, while another LPN stated the resident required one-person assistance with toileting because she could not adequately reach her perineal area. The DON stated staff had previously been educated to provide the resident assistance with perineal care and transportation whenever she requested it. The facility also failed to maintain a respectful environment for residents when two staff members argued loudly and used profanity in a dining area while residents were present. A CNA stated an assistant dietary manager/cook confronted her in an intimidating manner and yelled profanities at her in front of residents. A resident who witnessed the event stated he and another resident were sitting at their usual table when the argument occurred and that they waited to leave until the staff members were gone. Another resident stated she heard the employees yelling and did not like conflict, and a third resident stated the yelling was uncalled for and gave her headaches because she prefers a quiet environment. An LPN and a floor care technician both stated the shouting was heard by residents during breakfast. The Administrator stated employees should not engage in verbal altercations in front of residents and that residents should be able to eat their meals in peace.
