Summary

The facility failed to protect a resident’s right to be free from sexual abuse by another resident. The abuse prevention policy stated that the facility prohibits abuse, neglect, exploitation, misappropriation of property, deprivation of goods and services by staff, and mistreatment, and that it must take all reasonable measures within its control to prevent abuse and maintain a resident-secure environment. The policy defined sexual abuse to include non-consensual sexual activity or sexual activity involving an individual who lacks the capacity to consent. R71, who was documented as cognitively intact, reported that R23 had been kicking the back of R71’s wheelchair and, when R71 turned around, R71 observed R23 holding or grabbing R23’s genital area. R71 stated the incident occurred near the doorway of R71’s room and that a CNA witnessed it. R71’s record also documented a resident-to-resident sexual allegation and a psychosocial assessment, after which one-to-one staff supervision and support were implemented for R71. R71’s care plan identified R71 as low risk for abuse and neglect and included a goal that R71 would feel safe and secure in the facility. R23 was also documented as cognitively intact, but the care plan described a history of impaired boundaries, sexually inappropriate behaviors, poor impulse control, and limited self-regulation, with prior reports of inappropriate, sexually oriented, and suggestive remarks toward others. The record also noted a failed GDR of Prozac with sexually inappropriate behaviors following the dose reduction. A preliminary abuse investigation report documented that R23 was behind R71, pushing R71’s wheelchair with a foot while R23’s genital area was exposed and held in R23’s hand. A CNA stated he observed R23 following R71, with R23’s foot on the back of R71’s wheelchair and R23’s exposed penis in R23’s hand, and immediately separated the residents. Staff interviews further confirmed R23’s long history of inappropriate behavior toward staff and other residents and that R23 was independently mobile throughout the facility.
