Unsafe AMA Discharge Without Guardian Involvement or Medications
Summary
The facility failed to ensure an appropriate and safe discharge process for a resident with serious mental illness and multiple medical conditions, including schizophrenia, gestational hypertension, post-traumatic stress syndrome, mood disorder due to known physiological condition with depressive features, psychotic disorder with hallucinations, anxiety disorder, hypomagnesemia, and a history of falling. The resident’s record identified a court-appointed State Guardian as the legally authorized representative responsible for healthcare decision-making and participation in care planning. Hospital records described the resident as requiring a high-acuity psychiatric and medical stabilization environment, with a history of self-harm, physical aggression, unstable housing, active psychosis, and a need for 24-hour supervision and medication management. The resident repeatedly stated a desire to leave against medical advice, and nursing documentation noted that risks of leaving were explained and that the resident continued to refuse treatment and requested discharge. The resident signed an AMA form, with a facility witness signature, and left the unit ambulatory with personal belongings. The LPN stated that the resident insisted on leaving, that the resident was told it was not safe to leave, and that the resident said she was going to a shelter house. The LPN also stated that the State Guardian was not called before the resident left, the primary doctor was not called, and no medications or prescriptions were provided at discharge. The State Guardian stated that the facility informed her after the resident had already left and that she was not told in advance that the resident was discharging. The guardian stated she had not met the resident, did not know where the resident went, and had no way to contact her. The Behavioral Health Director stated that if a resident has a State Guardian and wants to leave AMA, staff would explain that it is not safe to discharge, call the primary doctor and psychiatrist, and call the State Guardian. The psychiatric NP stated that the call she received did not include information about psychosis, suicidality, aggression, delirium, incapacity, guardianship, or unsafe discharge concerns, and she stated that she does not discharge residents. The Assistant Administrator stated that if a resident has a guardian, the State Guardian should sign the AMA form and that the guardian is the decision maker. The resident’s primary doctor stated that if contacted about the resident wanting to leave AMA, the answer would have been no.
