Failure to Protect a Nonverbal Resident from Visitor Assault

Summary

The facility failed to protect a resident from abuse and inappropriate physical contact. The resident was a female with early onset Alzheimer’s disease, anxiety disorder, impaired communication, and a care plan showing she was totally dependent on staff for all activities of daily living, required two staff for turning and repositioning, was non-ambulatory, and was non-verbal. At the time of observation, she was lying in bed, unable to speak, with contracted upper and lower extremities, clenched teeth, and an anxious expression. On the day of the incident, a male visitor entered the facility, signed the visitor log with an illegible signature, and proceeded toward the resident’s room. A nurse observed the visitor walking down the hall and later found him in the resident’s room with the curtain partially closed. The nurse reported that the visitor was standing at the bedside, speaking to the resident, and later returned to the room to find him with his pants zipper down, his hand near his penis, and a black object with a white string in the resident’s mouth. The nurse stated the visitor was adjusting the object in the resident’s mouth, then pulled on the string repeatedly, pushed the resident’s forehead into the mattress, and ran into the bathroom before pushing past the nurse and leaving the area. The resident was admitted to the hospital for possible assault, and the record shows a rape kit was completed, including the oral and upper portion. Police responded to the facility and documented that an unknown male visitor placed an unknown object inside the female patient’s mouth and fled. The police report described the object as a garage plug and rope from the visitor’s garage, along with a spacer used to keep a mouth open. Facility staff, including the receptionist, social services assistant, DON, ADON, and administrator, described visitor sign-in and screening processes, but the investigation concluded there was no credible evidence that abuse occurred.
