Summary

The facility failed to provide sufficient nursing staff and failed to have a licensed nurse in charge on each shift. During interviews, an RN stated she worked the night shift with 24 residents assigned and that there was no supervisor or charge nurse at the time. A CNA reported having 36 residents assigned, with times when she had 37, and said she was not able to give the best care with that many residents. An LPN stated she had 23 residents while her CNA had 36 residents, and another CNA stated that although the unit had 28 residents, only one CNA was working that night instead of the usual two. Resident and staff interviews described delayed response times and difficulty obtaining assistance. One resident stated it took a while to get help after calling and that waits could be up to one hour. Another resident’s call light was observed activated from 9:07 AM until it was answered at 9:26 AM, while two staff members were seen walking past during that time. Additional residents stated call lights stayed on for hours, that staff took forever to answer, and that they sometimes waited 40 minutes to an hour for help, including assistance with changing and feeding. One resident stated that by the time staff were able to feed him, his food was cold. Staff and leadership interviews confirmed ongoing staffing problems, including short staffing on multiple shifts, no-call/no-shows, delayed paychecks, and restrictions on overtime and agency use. The Administrator stated that four people had to be called in to help because staff sometimes no-call/no-showed, and that management and non-nursing staff were brought in to cover. The DON stated the facility was short on multiple weekends, that management worked extended hours to cover shifts, that agency staff were not arranged, and that when CNAs were short, nurses should have been used as aides. Review of census and timesheets showed periods where staffing was limited despite a census of 104 to 106 residents, including nights with only three CNAs and three nurses, or four nurses and four CNAs on duty. The facility policy stated it was the policy to provide sufficient staff and designate a licensed nurse to serve as charge nurse on each tour of duty.
