Failure to Protect Residents from Verbal Abuse

Summary

The facility failed to protect two cognitively intact residents who required staff assistance for personal care from verbal abuse by a nursing assistant. Resident #1 had diagnoses including Parkinson’s disease, mood disorder, psychotic disorder with hallucinations, anxiety, and depression, and required moderate assistance with incontinence care. Resident #4 had diagnoses including atrial fibrillation, anxiety, and depression, and also required moderate assistance with personal care and incontinence care. Resident #1 reported that NA #1 made repeated inappropriate comments about his/her body during hygiene and incontinence care, including remarks about having a "big a**" and comments about needing a larger brief because of body size. Resident #1 stated he/she told NA #1 the comments were inappropriate, but NA #1 responded that the comments were acceptable in his culture. Resident #1 then began avoiding assistance from NA #1 unless necessary and changed the type of underwear worn to reduce contact with the staff member. Facility interviews documented that Resident #1 felt uncomfortable, upset, and reluctant to report the behavior because he/she did not want to get anyone in trouble. Resident #4 also reported repeated inappropriate comments by NA #1 during care. Resident #4 stated NA #1 made unsolicited sexualized remarks about his/her breasts and made statements implying sexual activity with another resident, along with other comments that Resident #4 would not repeat because of embarrassment and shame. Resident #4 described feeling uncomfortable on several occasions, including an incident where NA #1 was seen looking through a bathroom door while Resident #4 was on the toilet. Resident #4 also reported that NA #1 made threatening or harassing remarks while passing by. The facility’s own review determined that NA #1 failed to follow facility expectations regarding customer care and made repeated comments that made residents feel uncomfortable, and the facility identified the comments as verbal abuse under its abuse policy.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
