Summary

The facility failed to ensure Resident #2 was free from abuse when Resident #1 entered Resident #2's room and touched Resident #2 inappropriately. Resident #2 had diagnoses including affective mood disorders, Parkinson's disease, depression, and anxiety, and the annual MDS identified intact cognition with a BIMS score of 15, partial assistance needed for bed mobility and transfers, no ambulation, and no behaviors. The care plan noted a mood problem related to depression and anxiety, psychotropic medication use, and a history of Resident #2 making physical accusations toward another resident. Resident #1 had diagnoses including conversion disorder with seizures or convulsions and anxiety disorder, and the 5-day MDS identified intact cognition with a BIMS score of 15, partial assistance needed for transfers, no ambulation, independent wheelchair mobility, and no behaviors. The care plan noted mild depression and psychotropic medication use. On the evening of the incident, nursing documentation and the reportable event form stated Resident #2 alleged Resident #1 touched the private area over clothing and blankets, with no injuries observed. Resident #1 denied the interaction, was placed on one-to-one observation, the provider and police were notified, and Resident #1 was sent to the ED for psychiatric clearance. Interviews and facility records showed Resident #1 had been self-propelling throughout the facility and was seen in or near Resident #2's doorway before the allegation. Resident #2 stated Resident #1 first entered the room and touched Resident #2's feet, then returned later and reached under the sheets to touch Resident #2's feet and legs and placed hands on top of the brief. The DON and Admissions Director stated the facility's admission process required a sexual offender screening before admission, but it was not completed for Resident #1. They identified that a later review found Resident #1 had a previous sexual assault charge and that the correct screening would have prevented admission.
