Summary

The facility failed to ensure a resident with intact cognition and a BIMS score of 15 was treated with respect and dignity when staff responded to the resident’s difficult behaviors with disrespectful language on two separate occasions. The resident reported that an LVN told him, “Don’t act like a Devil,” after he asked why the nurse had not answered the phone when he was trying to get help for a low oxygen tank. The resident stated that this made him feel bad and that he still felt bad every time he saw the LVN. The resident also reported that during personal care, when he asked a CNA to change cold water and did not remember the CNA’s name, the CNA called him “boy,” and then, after becoming upset, called him a racial slur several times. The resident stated he felt threatened, disrespected, and still felt bad about the interaction. Staff interviews confirmed that the resident had called staff names and yelled at them, and staff acknowledged responding in kind, including the LVN saying “don’t act like a devil” and the CNA stating he responded after the resident called him “boy.” The facility policy stated employees shall treat all residents with kindness, respect, and dignity.
