Psychological Consult Not Implemented for Resident With Emotional Distress

Summary

The facility failed to ensure interventions were implemented to maintain and prevent decline in the psychological functional ability of one resident when the resident did not receive a psychological or behavioral health consult as outlined in the comprehensive care plan. The resident was admitted in 2024 with diagnoses including hemiplegia and hemiparesis, dysphagia, muscle weakness, and aphonia. The resident’s MDS dated 5/10/26 showed a BIMS score of 12 out of 15, indicating moderate cognitive impairment. On 4/18/26, staff documented that the resident was crying and using a communication board to report that a CNA had been insisting and yelling at him to turn himself around repeatedly. The resident indicated he could not turn himself on his own. The care plan initiated that same day identified the resident as having potential/risk for psycho-social distress related to alleged verbal abuse and included an intervention for a psychology/behavioral health consult as indicated, along with encouragement to verbalize feelings and attentive listening. On 4/20/26, the interdisciplinary care conference documented the same concern and added recommendations for psychosocial visits, monitoring for psychosocial disturbance every shift, and a psychiatric referral related to episodes of depression. Subsequent documentation showed continued emotional distress. A social services note on 4/20/26 recorded that the resident felt sad after the incident. The PHQ-2 to 9 evaluation dated 5/7/26 indicated the resident had been feeling down, depressed, or hopeless for 7-11 days in the prior 14 days, and a care plan was initiated for a resident-to-resident altercation after the resident was hit in the right lower extremity by another resident. During interviews, staff stated the resident had no prior behavioral issues, could have felt sad, upset, hurt, unsafe, or depressed, and that there was no documentation of a psychiatric evaluation since 3/2026. The DON and SSD stated the resident’s care plan included a psychology/behavioral health consult, but the SSD could not find documentation that staff had asked the resident if he wanted a psychiatric evaluation, and the resident’s responsible party later stated the facility called only on 6/16/26 to ask about a psychiatric referral.
